Mr. Kunal Thakur, Deputy Advocate General, for the non-applicant/appellant-State.
Through Video Conferencing
By way of instant communication dated 13.01.2021,
which has been registered as Cr.MP No.161 of 2021, prayer has
been made on behalf of Additional Sessions Judge-I, Kangra at
Dharamshala for extension of time to comply with the order dated
7.9.2020, passed by this Court in Cr.MP No.1175 of 2020, whereby
this Court extended the time by six months to conclude the trial
in terms of order/judgment dated 25.6.2020 passed by this Court
in Cr.MP(M) No.885 of 2020. Since court below on account of some
unavoidable circumstances has been not able to do the needful
within the time stipulated by this Court, fresh prayer has been
made on behalf of learned Court below to extend the time by six
months, however, taking note of the fact that prior to filing the
application at hand, this Court vide order dated 7.9.2020 had
already granted six months time on the request of learned court
below, this Court deems it fit to grant further three months time
to learned court below to do the needful in terms of
order/judgment dated 25.6.2020. Ordered accordingly.
Registry is directed to apprise the learned Court
below with regard to passing of the instant order, enabling it to
do the needful within stipulated time. Since, on two occasions
this Court has extended time on the request of learned court
below, fresh communication, if any, for extension of time would
.
not be appreciated. The application stands disposed of.
