Heard Mr. SK Goswami, learned counsel for appellant and Mr. G Jalan, learned counsel for respondent Nos.1 and 2.

It may be noted herein that as per order dated 20.12.2016 in the connected I.A. (Civil) 1851/2016, the names of respondent Nos. 3 and 4 have been struck off.

By this appeal under Section 173 of the MV Act, the appellant has prayed for setting aside the Judgment and Award dated 05.06.2015 passed by learned Member, MACT No.1, Kamrup in MACT Case No. 654/2011.

The appeal is admitted subject to deposit of Rs.40,000,00/- (Rupees Forty Lakhs) of the awarded amount to the claimant with the Registry of this Court within 6(six) weeks.

The aforesaid amount shall be released on execution of a bond of claim by the claimant on proper identification.
