jail, the delay in preferring the appeal is condoned.

3. Department is directed to call for the LCR expeditiously.

4. There shall be stay of realization of fine, if any, pending

disposal of the appeal.

5. Department is directed to prepare the paper book after receipt

of LCR.

6. Learned Counsel for the appellant is directed to serve a copy

of the appeal memo along with impugned judgment to the

office of the learned Public Prosecutor, High Court at Calcutta

in the meantime.
