Judgment On : 25.07.2022.

Bibek Chaudhuri, J.

Both the petitioners and opposite party No.2 have filed a joint

petition for compromise, stating, inter alia that Jadavpore Police

Station Case No.506 of 2010 dated 6th October, 2010 under Sections

498A/34 corresponding to A.C.G.R. Case No.2054 of 2017 pending

before the Court of the learned Additional Chief Judicial Magistrate at

Alipore has been settled by and between the parties amicably and the

parties are not willing to proceed with the aforesaid case.

I have perused the joint compromise petition. The terms and

conditions of settlement is found to be lawful.

However, by an order dated 10 th June, 2022, a Co-ordinate

Bench directed the Investigating Officer to record a statement of the

opposite party No.2 to ascertain as to whether the dispute between

the parties has been amicably settled or not. The opposite party

made a statement before the Investigating Officer admitting

settlement of the dispute between the parties. However, she denied

false charges levelled against her by the petitioners/accused persons

that she extorted money for effecting compromise. The petitioner has

prayed for bringing the fact on record that she has not claimed or

accepted any money for settlement of the case and future

maintenance of herself and her minor daughter.

Since the present dispute is compromised between the parties,

further proceedings in connection with A.C.G.R. Case No. 2054 of

2017 arising out of Jadavpore Police Station Case No.506 of 2010

under Sections 498A/34 of the Indian Penal Code be quashed.

For abundant caution it is recorded that for effecting

settlement, the opposite party No.2 has not accepted or demanded

any money from the petitioners and the petitioners are prevented

from taking any legal action of such allegation against the opposite

party No.2 in future.

The instant revision is, thus, disposed of.
