Heard the appellant-in-person and Sri Anil Kumar Singh Visen, learned Counsel for the respondent No.1, Sri Savitra Vardhan Singh, learned counsel for respondent Nos.2, 3 and 5/University and Sri Shubham Kumar, Advocate holding brief for Sri Rajesh Tiwari, learned counsel for the respondent No.4.
The appellant-petitioner has assailed the judgment and order dated 11.03.2024 passed in Writ-C No. 2307 of 2024, Shubhanshu Bansal v. State of U.P. and others whereby the writ petition filed by the appellant-petitioner has been disposed with certain directions.
On account of some reservations, the opposite party No.4, who was the Research Guide of the appellant-petitioner during his Ph.D. programme has discontinued his guidance on account of which the present appellant-petitioner has not been able to pursue the course for some time.
It appears that some complaints came to be made against the appellant-petitioner to pursue Ph.D. course in the subject of Physics. It is not in dispute that the appellant-petitioner has been enrolled as a Research Scholar for the award of Ph.D. degree. It is also not in dispute that he underwent the research programme for some time under opposite party No.4, who later on discontinued his supervision for some reasons best known to him.
At this stage, due to intervention of this Court, the appellant-petitioner has been provided a new Research Guide, namely, Prof. R.B. Singh and the appellant-petitioner is at liberty to report before the guide assigned to him for carrying out the research studies of Ph.D. Course. The break in pursuing the Ph.D. course which has occurred for the fault of any parties may be compensated by granting necessary extension to accomplish the Ph.D. course as per the Rules and Regulations applicable in this regard. The appellant-petitioner is expected to attend the studies regularly and not to indulge into any activity unbecoming of a Ph.D. Scholar.
With the aforesaid observations and modifications in the impugned judgment and order dated 11.03.2024 passed in Writ-C No. 2307 of 2024, Shubhanshu Bansal v. State of U.P. and others, the Special Appeal stands disposed of.
