Pursuant to the order dated 10.09.2024, report of District Judge, Mainpuri has come, which is on record.

I have perused the said report.

This writ petition has been filed seeking a direction upon the Court below to proceed with the Execution Case No.2 of 2003 which is pending before the Court of Civil Judge (J.D.), Mainpuri for the execution of the judgment dated 15.04.1978 within fixed period of time.

Earlier, this Court on 13.03.2013 had directed the Court below to expedite the execution proceedings by imposing cost starting for Rs.300/- per adjournment.

This Court finds that more than 11 years have elapsed, but the execution proceedings have not been completed by the Court concerned, though the judgment is of the year 1978.

As a last opportunity, the Civil Judge (J.D.), Mainpuri is granted six weeks' time to immediately comply the earlier order passed by this Court, and decide the Execution Case No.2 of 2003 within the time framed hereinabove after hearing all the affected parties in accordance with law.

With the aforesaid observations, writ petition stands disposed of.

The Civil Judge (J.D.), Mainpuri shall convey the decision taken by him, within the time period fixed above, to the Registrar (Compliance).
