HIGH COURT OF JUDICATURE AT ALLAHABAD ?Court No. - 29 Case :- CIVIL MISC REVIEW APPLICATION No. - 571 of 2022 Applicant :- Munendra Pal Singh Opposite Party :- State Of U.P. And 3 Others Counsel for Applicant :- Ganesh Mani Counsel for Opposite Party :- C.S.C. Hon'ble Manoj Misra,J.
Hon'ble Vikas Budhwar,J.
This review application seeks review of our order dated 17.11.2022 on the ground that the Court passed the order in the absence of the counsel for the appellant.
Interestingly, there is no affidavit of the counsel for the appellant. In the order dated 17.11.2022 we have specifically mentioned that we have heard the counsel for the appellant. Otherwise also we have dismissed the appeal as not maintainable by recording detailed reasons and also by relying on a judgment of the Apex Court. There is no averment in the affidavit that the view taken by us is ex-facie erroneous or against any binding precedent.
In such circumstances, the review application is misconceived and is accordingly rejected.
