Short Counter Affidavit filed on behalf of the respondent nos. 4 is taken on record.

Heard learned counsel for the petitioners; Sri Varun Singh, learned for the respondent no. 4 and the learned AGA for the State respondents.

This writ petition has been filed with the prayer to quash the First Information Report dated 16.6.2022 registered as Case Crime No. 0200 of 2022, under Sections 420, 406 IPC, P.S. Pallavpuram, District Meerut in view of the compromise entered between the parties.

On the basis of averments contained in the short counter affidavit, it has been claimed that the dispute has come to be amicably resolved between the parties by settlement dated 18.8.2022 under which the respondent no. 4 is entitled to receive Rs. 12,00,000/- from the petitioner, as such, pending proceedings would serve no purpose and the same are liable to be quashed in the light of the judgements of the Apex Court in the case of Gian Singh v. State of Punjab, 2012(10) SCC 303.

In the facts and circumstances, no useful purpose would be served in keeping the writ petition pending for consideration and with the consent of the parties, the writ petition stands disposed of asking the I.O. concerned to proceed strictly in accordance with law but certainly taking into account the aforesaid settlement/compromise dated 18.8.2022 and judgment cited above.

For a period of two months, respondents are restrained to arrest the petitioners pursuant to the impugned FIR subject to cooperation in the on-going investigation.
