At the outset, learned A.G.A. has raised a preliminary objection that the applicant has directly approached this Court without the avenues available before the concerned court of sessions exhausted, therefore, in view of the judgment of Larger Bench consisting five Judges of this Court in the case of Ankit Bharti and others vs. State of U.P. and Another 2020 (3) A.D.J. 575 (F.B.), this anticipatory bail application is not maintainable.
In reply, learned counsel for the applicant submits that he does not want to press this application at this stage, therefore, the same may be dismissed as withdrawn with liberty to the applicant to approach the concerned court below.
In view of the above, the instant application is dismissed as withdrawn the the aforesaid liberty.
