"Tharoor has intended to to create a great conflict & disharmony based on religious divide," Complainant. 

A Metropolitan Magistrate Court in Kolkata, on Friday, summoned Congress leader Shashi Tharoor to appear before it in connection to a criminal complaint filed against him following his “Hindu Pakistan” jibe. In another case filed with the city court, Nasir-Ul Islam - deputy grand mufti of Jammu & Kashmir has been summoned by the court.

Shashi Tharoor was embroiled in a huge controversy after his remark that if voted to power again, the BJP would change the Constitution of India to make India a 'Hindu Pakistan'. While the comment drew flaks from the saffron brigade, the Congress kept mum on the comment of the Thiruvananthapuram MP.

During a lecture, Tharoor claimed that lacking two-third majority in the Rajya Sabha stopped the BJP from rewriting the Indian Constitution.

Based on Tharoor’s comments a city lawyer on Friday filed a criminal complaint with the Bankshall Court claiming that it has hurt the religious sentiments of the Indians & the comment was an insult to the Constitution of India. “

He has intended to to create a great conflict & disharmony based on religious divide. He has even refused to apologize for the remarks,” Adv. Sumeet Chowdhury said.

Alleging that Tharoor has compared India with other Islamic states like Pakistan the lawyer said, “the case has been filed under sections 153A & 295A of the Indian Penal Code & section 2 of The Prevention of Insults To National Honour Act, 1971.”

In another case filed against Nasir Ul Islam, the vice president of the Muslim Personal Law Board of Jammu & Kashmir by Sharad Kumar Singh, the city court has asked the accused to appear before it. Islam had earlier commented that the Muslims in India need to demand a separate country for themselves.

“The case has been filed against Nasir Ul Islam under sections 121A, 153A, 295A of IPC. In both the cases the court has asked the accused persons to appear before it on August 14,” Chowdhury said.
