A Delhi based lawyer facing rape and assault charges has approached the Delhi High Court seeking to quash the criminal proceedings on the ground of a private settlement with the complainant, even as his plea for anticipatory bail was deferred and listed alongside the quashing petition later this month, keeping the prosecution firmly alive for now.

The case stems from an FIR lodged in June 2025 at the Neb Sarai Police Station, where a 27-year-old advocate accused the 51 year old lawyer of repeated sexual assault over several years on the promise of marriage, criminal intimidation, and physical violence. The allegations included a forced abortion earlier this year and a subsequent assault at a South Delhi country club, portions of which were said to be captured on CCTV. The matter drew national attention after allegations surfaced that two judicial officers had attempted to influence the complainant to withdraw the case, prompting administrative action and disciplinary proceedings by the High Court.

Following the trial court’s refusal to grant him anticipatory bail, the accused lawyer moved the High Court, coupling his bail plea with a petition to quash the FIR based on a claimed amicable settlement.

When the matter came up before Justice Amit Mahajan, the Court indicated that the bail plea could not be taken up immediately, as the judge had earlier declined relief to the petitioner, and observed that the matter may be placed before another bench. Senior counsel for the accused urged that the quashing petition, anchored in a Memorandum of Understanding dated November 29, 2025, be heard together with the bail plea.

The petition asserts that the parties have “voluntarily entered into” a settlement to “bring closure to all disputes.” The Court ultimately adjourned both matters to December 22, issuing notice to the Delhi Police and the complainant, without expressing any view on the merits of the settlement or the serious allegations involved.
