The Allahabad High Court has directed Superintendent of Police, Kushi Nagar to produce prosecutrix Smt. Archana Bharti before the court on next date of hearing. The Single Bench of Justice J J Munir while hearing an application filed by one Dilip Prasad has ordered that,
“Let the prosecutrix Smt. Archana Bharti d/o Ram Naresh Prasad r/o Madhwaliya, Ahirauli Bazar, Kushi Nagar, Police Station Ahirauli Bazar, District Kushi Nagar be caused to be produced before this Court by the Superintendent of Police, Kushi Nagar on 10.02.2021 at 02:00 p.m.”
The fact of the present case are that applicant and Archana Bharti got married voluntarily. But Archana’s father Ram Naresh Prasad has filed a false kidnapping case against the petitioner. The Government Advocate has submitted that the wife has stated in a statement before the magistrate that she does not want to be with the petitioner and the Police has also filed a chargesheet on the kidnapping charge.
On this the applicant has submitted before the court that she gave that statement before the magistrate under family pressure. The court has directed Victim also to be present before the court on next date. The matter has been listed on 10th February for next hearing.
