Taking suo-moto cognizance of the assault being hurdled on a Lawyer by the Uttar Pradesh Police in Eath, the Allahabad High Court has now ordered an inquiry into the matter.
The Court has listed the matter for physical hearing today and upon hearing passed the above order inter alia directing to submit a report on the same.
The Bench comprising of Chief Justice Govind Mathur and Justice Saumitra Dayal Singh has also ordered for the custody of the accussed till next date of hearing.
THE MATTER
Earlier, the Uttar Pradesh Police had broken the door of Advocate Rajendra Sharma's house in Etah and used physical force on him i.e. dragging him out while he was in his Advocate's uniform and assaulting him aggressively. The video of the incident went viral on social media led to widespread condemnation of the brutality and misbehviour.
Bar Council of India when came across the incident took immediate note and wrote to the Chief Justice of India, Justice SA Bobde and the Chief Justice of Allahabad High Court, Justice Govind Mathur, requesting them to take immediate steps against the Police Personnel who assaulted the Lawyer.
The BCI in the letter, mentioned the viral video in the letter and also highlighted the concern of the Uttar Pradesh Bar Council in this regard. The response from the Uttar Pradesh Govt was a disappointing affair as the State didn't even consider it. Further, allegation has been levelled by the Bar Council of India that the Police Personnel was acting with some 'ulterior motive' and thus has sent caution that if such incidents of brutality are ignored by the Judiciary and the Government, the 'Bar will have no option except to come on roads'.
Collecting more support, the Supreme Court Bar Association had also released a statement on Monday condemning the Police action against the Lawyer.
The matter has now been listed for January 8th, 2021.
