              CONTEMPT CASE No.1580 of 2023
ORDER:

This contempt case is filed alleging violation of the order

passed by this Court W.P.No.5626 of 2023, dated 28.02.2023,

wherein this Court directed the respondents to deposit the

entire decretal amount covered by the judgment and decree in

O.P.No.39 of 2015, dated 10.10.2017, into the credit of

E.P.No.32 of 2019 on the file of the Senior Civil Judge at

Wanaparthy within a period of four months.

2. In response to the notice in Form-I issued by this Court,

it is brought to the notice of this Court by learned Government

Pleader for Land Acquisition that the amount, as directed by

this Court, was already deposited into the credit of E.P.No.32 of

2019 on 31.10.2023 and a copy of the G.O.Rt.No.354, Irrigation

and CAD (LA) Department, dated 27.10.2023, and a copy of the

letter bearing No.C/03/2018, dated 31.10.2023, addressed

to the Court of the Senior Civil Judge, Wanaparthy, are placed

before this Court in proof of having deposited an amount

of Rs.73,00,409/- through Cheque No.02001731, dated

31.10.2023. However, it is submitted by learned Government

Pleader for Land Acquisition that aggrieved by the order passed

by this Court in L.A.A.S.No.28 of 2018, dated 20.09.2022, the

State has preferred an appeal before the Hon'ble Apex Court

and the same was taken on record and a Diary Number

was assigned and the same is likely to come up before the

Hon'ble Apex Court.

3. Be that as it may, there is no stay granted against the

order passed in L.A.A.S.No.28 of 2018 and the judgment and

decree passed in O.P.No.39 of 2015 was confirmed.

4. In the light of the above, this Court does not see any

deliberate violation on the part of the respondents as the

respondents have already complied with the order passed by

this Court, this Court is not inclined to continue further

proceedings against the respondents.

5. The contempt case is accordingly closed.

Miscellaneous Petitions, if any, pending in this contempt

case shall stand closed.
