Let notice should go to respondent No. 2 through both
process.
Requisites be filed within ten days.
Learned Public Prosecutor accepts notice on behalf of State-
respondent.
Respondent No. 2 is wife of petitioner No. 1, allegation is
under Section 498-A & 406 IPC against the petitioners.
Learned counsel for the petitioners submits that petitioner
No. 1 had filed a civil suit for restitution of conjugal rights. The
said matter was decided in favour of the petitioner vide judgment
dated 29/10/2015.
On non-compliance of the said order, petitioner No. 1 filed an
application for decree of divorce and thereafter, the impugned FIR
has been filed to pressurize the petitioners.

Considering the aforesaid facts, it is directed that the
petitioners shall not be arrested in connection with FIR No.
136/2022 registered at Police Station Fatehpur Kotwali, Sikar till
further order with condition that the petitioners shall fully
cooperate with the investigation of the case.
