Heard learned counsel for the appellant, learned Public
Prosecutor and perused the material available on record.
The appellant has been convicted and sentenced vide
judgment dated 16.09.2016 passed by learned Additional Sessions
Judge, Sangria in Session Case No.18/2014. The charge against
the appellant is of murdering his own wife and his two children.
Shri Gill has advanced the plea of insanity in an attempt to crave
indulgence of bail for the appellant. However, while appreciating
this plea, the entire evidence will have to be seen because it
seems that no application under Section 328 Cr.P.C. was filed by
the defence during pendency of the trial. Thus, the application for
Suspension of Sentence is dismissed as being devoid of the merit.
The appeal shall be listed for hearing in the 3 rd week of April,
2022.
