Counsel for petitioner states that petitioner participated in

the recruitment process on the post of Fireman, pursuant to

advertisement dated 10.08.2021 and petitioner qualified the

written examination dated 18.04.2022 and was called for Physical

Efficiency and Practical Examination on 06.12.2022. Counsel for

petitioner further states that petitioner is not able to appear for

Physical and Practical Examination, due to pregnancy.

Counsel for petitioner has placed reliance on the order dated

09.04.2021 passed in S.B. Civil Writ Petition No.4778/2021

whereby and whereunder on the similar set of facts, the Co-

ordinate Bench of this Court on placing reliance on the previous

other judgments, has issued notices and protected the interest of

petitioner provisionally.

Heard.

Issue notice to respondents.

In the meanwhile, candidature of petitioner for the post of

Fireman shall not be rejected on account of non-appearance in the

Physical Efficiency Test and one post shall be kept vacant for the

petitioner.
