Prayer in the present petition is for directing the respondents i.e.

State of Haryana and its Local Bodies to provide shelter of suitable sizes to

horses, bullocks and camels driving vehicles and further to direct the

Municipal Bodies to make adequate provisions for housing the stray cattle

and to provide them food/fooder and water for welfare/protection of stray

animals.

Learned counsel for the petitioner places reliance on the

judgment dated 31.05.2019 passed by this Court in CRR-533 of 2013 titled

as 'Karnail Singh and others Vs. State of Haryana'.

Learned counsel for the petitioner was confronted with the fact

that once an order has already been passed by a Coordinate Single Bench of

this Court in CRR-533 of 2013, a violation whereof is being alleged by the

petitioner, how a writ petition for implementation of the said order would be

maintainable, he informs that the petitioner has also filed COCP-1618-2021,

which is already pending before this Court.

A further question was raised as to the nature of the relief

claimed being non-adversarial and being in the nature of larger public

welfare, how a writ petition in the nature of PIL can be entertained before a

Single Bench.

Faced with above, counsel for the petitioner seeks withdrawal

of the present petition so as to pursue his remedies in accordance with law.

Disposed of as withdrawn with the liberty as aforesaid.
