This appeal under Section 100 of CPC has been filed against the judgment and decree dated 05.07.2019 passed by Fifth Additional District Judge, District Tikamgarh in RCA No.08/2019 arising out of judgment and decree dated 29.06.2018 passed by Fourth Civil Judge Class-I, Tikamgarh in Civil Suit No.111A/2016.

It is submitted by the counsel for the appellant that on account of an out of Court compromise, the appellant has handed over vacant possession of the suit premises to the plaintiff by order dated 14.07.2021 passed by the trial Court and accordingly, it is submitted that the appeal has rendered infructuous.

It is accordingly dismissed as infructuous.
