Heard on I.A. No.7766/2023, an application under Section 5 of Limitation Act for condonation of 2609 days in filing this revision petition.
Learned counsel for the petitioner submitted that the petitioner is an illiterate labour, he had gone out of state to earn his livelihood, therefore, he was not aware about the judgment of conviction, hence the delay in filing this revision and prayed that the delay be condoned.
Learned Govt. Advocate opposed the prayer. It is well settled in law that in the matter of condonation of delay liberal approach has to be adopted by Court, therefore, on due consideration of the submissions advanced by learned counsel for the petitioner and the reasons assigned in the application, which is supported by the affidavit I.A.
No.7766/2023 is allowed and the delay of 2609 days is hereby condoned.
Let the record of the Court below be requisitioned. As prayed by learned counsel for the applicant, list the matter for final hearing at motion stage in the week commencing 10.07.2023 and if for any reason the matter cannot be heard finally, I.A.No.7765/2023 an application for suspension of sentence shall be taken up on the next date of hearing.
