This second repeat application under Section 439 of Cr.P.C. has

been filed for grant of bail. First bail application of the applicant was

dismissed as withdrawn by order dated 27/10/2021 passed in MCRC

No.49878/2021.

The applicant has been arrested on 11/09/2021 in connection with

Crime No.699/2021 registered at Police Station Janakganj, District

Gwalior for offence under Section 376, 506, 376-D and 34 of IPC.

In compliance of order dated 30/03/2022, the DNA test report has

been received. According to which the DNA profile of the applicant has

been found in the incriminating articles of the prosecutrix.

In the light of the judgment passed by the Supreme Court in the

case of Hemudan Nanbha Gadhvi vs. State of Gujarat, passed on

28.09.2018 in Criminal Appeal No.913/2016, the counsel for the

applicant seeks permission of this Court to withdraw this application.

Accordingly, the application is dismissed as withdrawn.
