JUDGMENT
These writ petitions have been filed by persons with disabilities
under the Rights of Persons with Disabilities Act, 2016, (for short,
"the RPwD Act") challenging the rejection of their claim for service-
related benefits, including promotional prospects, seniority, probation
etc.
2. When these writ petitions came up for admission, the learned
Special Government Pleader raised a preliminary objection that since
the issues raised in these writ petitions pertain to service conditions
of government employees, the petitioners ought to have approached
the Kerala Administrative Tribunal (KAT), and therefore, the writ
petitions are not maintainable. In view of the contention as above, the
writ petitions were posted for hearing the question of maintainability.
3. Heard Sri.Liju.V.Stephen, the learned counsel for the
petitioners and Sri.Antony Mukkath, the learned Special Government
Pleader.
4. The learned counsel for the petitioners submitted that the
petitioners are differently-abled persons and, though they are in
government service, they have approached this Court by filing the 2025:KER:92754 WP(C) Nos.40953, 31098 & 31665 of 2025 ..10..
present writ petitions for violation of their rights under Article 14 of
the Constitution of India; and hence, the writ petitions are
maintainable. It is further submitted that the petitioners were initially
employed on temporary basis in different establishments under the
Government of Kerala through the Employment Exchange, and
thereafter, they were regularized on the basis of Ext.P1 Government
Order, GO(P) No.40/13/SJD dated 18.05.2013. The grievance of the
petitioners is that they have been denied all career-advancement
benefits incidental to service that are otherwise extended to regular
employees. According to the petitioners, such denial is per se
contrary to the statutory mandate of the Persons with Disabilities
(Equal Opportunities, Protection of Rights and Full Participation) Act,
1995.
5. It was further submitted that after regularisation, they were
directed to be appointed in supernumerary posts under various
Government establishments. However, in Ext.P1, it was stipulated
that upon the retirement of such appointees, the respective posts
would stand abolished. Hence, it became incumbent upon the
Government to lay down service conditions for such appointees,
including matters relating to seniority, probation, promotion, and
other consequential benefits. Accordingly, GO(P) No.01/16/SJD dated 2025:KER:92754 WP(C) Nos.40953, 31098 & 31665 of 2025 ..11..
03.02.2016 [Ext.P2 in WP(C) Nos.31098/2025 & 31665/2025 and
Ext.P3 in WP(C) No.409653/2025] has been issued, laying down the
service conditions for the said appointees with regard to their service
conditions such as seniority, probation, promotion etc. Thereafter,
similarly situated persons challenged GO(P) No.01/16/SJD dated
03.02.2016, which finally reached before the apex court; and the apex
court in Maya P.C. & others v. State of Kerala & another [2025
INSC 773] has found that the said order is discriminatory, irrational
and violative of Article 14 of the Constitution of India. Therefore,
according to the learned counsel for the petitioners, since the order,
which is the subject matter of challenge in these writ petitions, is
found by the apex court to be violative of Article 14 of the
Constitution of India, the petitioners have all right to approach this
Court under Article 226 of the Constitution of India.
6. The learned Special Government Pleader, on the other hand,
submitted that the writ petitions are purely service matters of State
employees and since there is an alternative remedy available under
the Administrative Tribunals Act, 1985, their remedy is to approach
the KAT and not this Court. Relying on the judgment of the apex court
in Leelavathi N. v. State of Karnataka [2025 KHC OnLine 6878],
the learned Government Pleader submitted that the High Court 2025:KER:92754 WP(C) Nos.40953, 31098 & 31665 of 2025 ..12..
should not entertain writ petitions under Article 226 bypassing
statutory remedies and hence, the writ petitions are not maintainable.
7. I have considered the rival contentions raised on both sides.
The Administrative Tribunals Act, 1985, is an Act to provide for the
adjudication or trial by Administrative Tribunals of disputes and
complaints with respect to recruitment and conditions of service of
persons appointed to public services and posts in connection with the
affairs of the Union or of any State or of any local or other authority
within the territory of India or under the control of the Government of
India in pursuance of Article 323 A of the Constitution. It is also
constituted for matters connected therewith or incidental thereto.
Administrative Tribunals are established to exercise the jurisdiction
of powers and authority conferred on the Administrative Tribunal for
the State by or under the Act. Article 323A of the Constitution of
India inserted by the 42nd amendment with effect from 03.01.1977
empowers the parliament to provide, by law, for adjudication of
disputes relating to recruitment and conditions of service of persons
appointed to public services and posts under the Union or the State.
Pursuant thereto, the Administrative Tribunals Act, 1985, was
enacted providing for establishment of Central and State
Administrative Tribunal as the forum of first instance in service 2025:KER:92754 WP(C) Nos.40953, 31098 & 31665 of 2025 ..13..
matters. The High Court's writ jurisdiction under Article 226/227
remains intact, but the settled principle is that the parties must
approach the tribunal, with the High Court exercising judicial review
thereafter as held in L.Chandra Kumar v. Union of India [1997
KHC 503]. The object of the Administrative Tribunals Act is to reduce
the mounting service litigation burden on the High Court to secure a
speedy and specialized adjudication of service disputes and to ensure
uniformity and efficiency in the redressal of grievances of public
servants. Similarly, the object of the RPwD Act is to fulfill India's
obligations under the UN Convention on the Rights of Persons with
Disabilities (UNCRPD); and the RPwD Act guarantees quality and
non-discrimination for people with disabilities by providing
reservations and promotional benefits in employment, and ensuring
"reasonable accommodation" in public services. Though it is a
beneficial legislation, it does not oust or override the jurisdictional
framework of the service tribunals. The petitioners herein, being
government employees, must raise their claims before the
appropriate forum. They can invoke the rights under the RPwD Act in
support of their claims. But, such claims must be raised before the
KAT as the tribunal is the forum of first instance. As per the Kerala
Administrative Tribunals Act, all service-related disputes including 2025:KER:92754 WP(C) Nos.40953, 31098 & 31665 of 2025 ..14..
issues relating to time-bound higher grades and pay fixation of
Persons with Disabilities employees are required to be adjudicated by
the KAT as the court of first instance, and the jurisdiction of the High
Court arises only thereafter.
8. The apex court in Leelavathi (supra), has held that High
Court should not entertain writ petitions under Article 226 of the
Constitution bypassing statutory dispensation. The tribunals created
under the Administrative Tribunals Act function as the court of first
instance in service matters. Certain exceptions under which a petition
under Article 226 of the Constitution can be entertained despite the
availability of an alternative remedy have been enumerated in PHR
Invent Educational Society v. UCO Bank and others [(2024) 6
SCC 579], which, as extracted in Leelavathi (supra), read as follows:
"37. It could thus clearly be seen that the Court has carved out certain exceptions when a petition under Art.226 of the Constitution could be entertained in spite of availability of an alternative remedy. Some of them are thus:
(i) where the statutory authority has not acted in accordance with the provisions of the enactment in question;
(ii) it has acted in defiance of the fundamental principles of judicial procedure;
(iii) it has resorted to invoke the provisions which are repealed; and
(iv) when an order has been passed in total violation of the principles of natural justice.
38. It has however been clarified that the High Court will not 2025:KER:92754 WP(C) Nos.40953, 31098 & 31665 of 2025 ..15..
entertain a petition under Art.226 of the Constitution if an effective alternative remedy is available to the aggrieved person or the statute under which the action complained of has been taken itself contains a mechanism for redressal of grievance."
9. Hence, where there is an efficacious alternate remedy
available, the High Court cannot entertain any matter squarely falling
within the domain of tribunals . The instances referred to in PHR
Invent Educational Society (supra), are instances of ultra vires or
illegal exercise of power by the statutory authority, violation of the
principles of natural justice, or where the vires of the parent
legislation itself is under challenge. Therefore, these are the
exemptions that have been carved out and reiterated by the apex
court. Admittedly, the facts of the present case do not fall under any
of these exemptions so as to warrant the maintainability of the writ
petitions before the High Court. The prayers in these writ petitions
purely come under service conditions. Hence, I hold that the writ
petitions are not maintainable and the petitioners have to agitate
their claims before the Kerala Administrative Tribunal.
Accordingly, the writ petitions are dismissed as not
maintainable.
