04/ 15.09.2025: Heard learned counsel for the petitioners and learned counsel for the State.

2. I.A. No.8185 of 2025 has been filed for ad-interim bail during the pendency of the instant criminal revision.

3. Learned counsel appearing for the petitioner submits that the case is arising out of section 498-A of I.P.C and section 4 of Dowry Prohibition Act and the learned Judicial Magistrate, Ist Class, Koderma by judgement and sentence dated 22.01.2025 passed in Domchanch P.S. Case No. 99/2017, corresponding to G.R. Case No. 1272/2017 has sentenced the petitioner to undergo simple imprisonment for one year under section 4 of Dowry Prohibition Act with fine of Rs. 5,000/- and in default the petitioner was directed to undergo S.I. for one month, the petitioner was further sentenced to undergo simple imprisonment for two year under section 498(A) of the I.P.C. with fine of Rs. 5,000/- and in default of payment of fine the petitioner was directed to further undergo simple imprisonment for one month. He submits that appeal preferred by the petitioner being Criminal Appeal No. 07/2025 has been dismissed by judgment dated 19.05.2025 and the order of the learned trial court has been affirmed.

4. Learned counsel for the petitioner submits that petitioner happens to be husband of the informant and there is general and omnibus allegation against him. He submits that rest of the accused persons have been acquitted and only petitioner has been convicted. He submits that P.W.4 who is wife has alleged allegations which are general and omnibus and the petitioner has remained in custody for five months and maximum sentence is two years and in view of that during the pendency of the criminal revision petition the petitioner may kindly be enlarged on bail.

5. Learned counsel appearing for the State submits that petitioner is husband and he has been convicted by two courts.

6. In view of above, issue notice upon the O.P. No.2 under registered cover with A/D as well as by ordinary process for which requisites etc. must be filed within one week.

7. Call for trial court record.

8. In the meantime, during pendency of this criminal revision petition, the petitioner above named, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Koderma in connection with Domchanch P.S. Case No. 99/2017, corresponding to G.R. Case No. 1272/2017, subject to the condition that one of the bailor must be own relative.

9. I.A. No.8185 of 2025 is allowed and disposed of.
