1. The instant contempt petition arises out of the order/judgment dated
12.12.2022 passed in WP(C) No.2693/2022, whereby the writ petition
preferred by the petitioner was disposed of at the very threshold, with the
direction to the respondents to accord consideration to the representation,
which is annexed as Annexure-VI with the writ petition, filed before the
Registrar Cooperative Societies, Jammu, within a period of six weeks' from
the date a copy of the order was supplied by the petitioner to the respondents
along with copies of the writ petition and annexures, strictly in accordance
with rules in vogue.
2. Since, the aforesaid order was not complied with, the instant contempt
petition has been preferred in which notice was issued on 18.03.2024 and the
respondents have filed the compliance report/statement of facts dated
27.02.2025, in which the respondents have taken a stand that the order passed
by this Court mentioned (supra) stands complied with and the representation
has also been accorded consideration. The compliance report filed by the
respondents has been placed on record along with detail consideration order
dated 21.02.2025 vide order No.01-JK(RCS) L.S. of 2025 issued by Registrar
Cooperative Societies, J&K.
3. Since, the direction was specific to the extent of according
consideration to the representation which was filed before the Registrar
Cooperative Societies, J&K which has been disposed of by the respondents
and detailed consideration order has been passed by virtue of which, it has
been decided that the allotment and handing over of possession of Shop
No.BG-30 in the Central Shopping Complex, Sanik Colony, Jammu to the
petitioner shall be carried out upon the constitution of the newly elected
Managing Committee, in accordance with the prescribed bye-laws, rules, and
regulations of the society.
4. In the aforesaid backdrop, no fruitful purposes will be served to keep
this contempt petition alive, as the order passed by this Court stands complied
with.
5. Accordingly, the proceedings in the instant contempt petition are
closed. Rule, if any framed, shall stand discharged.
