Learned counsel for the petitioners submits that in compliance to the judgment dated 24th June 2011 passed by the Joint Financial Commissioner with powers of Commissioner, Agrarian Reforms, J&K, Srinagar, the Tehsildar Agrarian Reforms (Khanyar) was supposed to do de-novo enquiry on spot and pass appropriate mutations in terms of Sections 4 and 8 of the Agrarian Reforms Act, 1976.
The aforesaid order of the Joint Financial Commissioner attained finality long back but has not been fully implemented by the Tehsildar. Notice returnable within four weeks. Requisite steps for service within one week.
List on 13th October, 20121.
In the meantime, Tehsildar Khanyar (Agrarian Reforms) shall submit status report with regard to the compliance of the judgment dated 24th June 2011 passed in File No. 483/Jt.FC/AP titled Jawhar Lal Koul Jalali Vs. Bashir Ahmad and others by the next date.
