ORAL ORDER
1. By the present writ petition, the petitioner is praying for writ, order or direction to the respondent authority for release the vehicle bearing registration No. GJ-02-BT-8550, which has been seized for the offence of illegal mining.
2. Learned advocate for the petitioner submits that the seizure memo of the vehicle does not disclose any material particulars and is in violation of the provisions of law. It is submitted that the petitioner has also submitted an application to the respondent authority on 20.12.2025 and has shown his willingness to pay the penalty also. He therefore, submits that the prayers prayed for in the present writ petition be granted.
3. Learned Assistant Government Pleader Mr.Nikunj Kanara, upon instructions from Mr.Dilip Rabari, Royalty Inspector, Mehsana, submits that a complaint has already been filed in the Special Court at Mehsana in respect of the vehicle in question. He submits that in view thereof, the petitioner be directed to approach the Special Court for the relief as prayed for in the present writ petition.

4. Considering the submissions and the fact that the complaint has already been filed by the respondent-authorities, the petitioner is directed to approach the Special Court for appropriate reliefs. If any application is preferred by the petitioner, the same shall be decided on its own merits in accordance with law. It is made clear that this Court has not gone into the merits of the case and no opinion is expressed thereon.
5. In view of the aforesaid, the present writ petition is disposed of. No order as to costs.
