1. At the very outset, learned counsel for the appellant seeks permission

of this Court to withdraw the instant appeal with liberty to file afresh

appeal and prays for return of certified copy of the impugned order.

2. Permission is granted, as prayed for.

3. Accordingly, the instant appeal is dismissed as withdrawn with the

aforesaid liberty. The Registry is directed to return the certified copy of

the impugned order after retaining photocopy of the same.
