                                                            ... for the defendant

The Court : Through this Master's Summons, the plaintiff in the

suit, inter alia, prays for extension of time to file its additional written

statement in response to the counter-claim introduced by the defendant in

its written statement by way of amendment.

By judgment dated June 13, 2025 the coordinate Bench had

allowed the defendant to incorporate its counter-claim by way of

amendment in its written statement and the plaintiff was directed to file

its additional written statement within 30 days from the receipt of the

amended written statement with counter-claim.
                                        2

The plaintiff admits that there is a delay for about 6 to 7 days

and accordingly, the plaintiff prays for extension of time to file its

additional written statement. The additional written statement has already

been submitted before the department on September 25, 2025 pursuant

to the leave granted by the coordinate Bench.

Be that as it may, for the ends of justice, the delay stands

condoned since this Court has been satisfied with the reasons shown in

the supporting affidavit.

The additional written statement filed by the plaintiff shall be

accepted formally and shall be treated as part of the suit record.

With the above observations and directions, GA-COM/3/2025

stands allowed, without any order as to costs.
