BEFORE:
The Hon'ble JUSTICE ARINDAM MUKHERJEE
Date: 7th November, 2025.

Mr. Partha Ghosh, Mr. Amal Kr. Datta, Mr. Debashis Das,
Mr. Bratin Suin, Advocates for the petitioner.

Mr. Manik Das, Advocate for the respondents.

The Court : The matter has been listed upon being mentioned by the

parties for correction of dates in the judgment and order dated 18th July,

2025. In some portions of the judgment instead of 12th September, 2013 the

death of the employee concerned has been erroneously recorded as 21st

October, 2013. Similarly the relief for Monthly Monetary Cash

Compensation (in short 'MMCC') has been awarded from 22 nd October, 2013

i.e. the date immediately succeeding the date of death which was

erroneously recorded instead of 13th September, 2013.

The date of death of the employee should be read, meant and

construed in the judgment and order dated 18th July, 2025 as 12th

September, 2013 and the date of granting relief for MMCC also should be

read, meant and construed from 13th September, 2013 instead of 21st

2025:CHC-OS:205 October, 2013 and 22nd October, 2013 respectively. Since there was an

erroneous recording of the date of death and also the date from which

MMCC is to be paid, the time for payment of current MMCC also stands

modified in the order dated 18th July, 2025 and shall be from the month of

December, 2025 which will be paid in the month of January, 2026. The

arrears of MMCC for the period between 13th September, 2013 till 30th

November, 2025 with accrued interest therein at the rate of 8% per annum

shall be paid within a period of four months from 1st December, 2025.

Let these corrections and modifications be incorporated in the

judgment and order dated 18th July, 2025.

(ARINDAM MUKHERJEE, J.)
