1. This writ petition has been filed with the following prayer:-

"1. direct the learned Civil Judge (Senior Division) Mathura to Proceed and decide the Civil Case No. 957 of 2023 (Smt. Geeta Devi and Another Vs. Smt. Vimlesh and Others) along-with Interim Injunction Application (7-Ga) filed by the Petitioners Pending before it, expeditiously within a short Period so stipulated by this Hon'ble Court. So that Justice may be done with the Petitioners."

2. The prayer made in the writ petition to the extent that Civil Case No. 957 of 2023 may be decided expeditiously cannot be granted in view of judgment of Division Bench of this Court rendered in case of Ali Shad Usmani vs. Ali Isteba, 2015 (2) ADJ 250 (DB). However, the prayer made for early deciding the application 7-C can be granted.

3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Civil Judge (Senior Division) Mathura to decide the application 7-C filed in Civil Case No. 957 of 2023, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order.

4. With the aforesaid directions, writ petition stands disposed of.

5. It is made clear that this Court has not adjudicated the matter on merits.
