3. Learned State counsel is present, who has been heard.

4. The present appeal has been filed by the appellants- Babu Ram and Dhan Singh against the judgment and order dated 17.12.2005 passed by learned Session Judge, E.C. Act, Rampur in Misc. Case No. 5/2005 in Sessions Trial No. 338 of 2000, Police Station Milak, District Rampur.

5. As per office report dated 28.08.2023 a report from C.J.M. concerned was called for regarding living status of the appellants in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 17.07.2023 informed that the appellants- Babu Ram and Dhan Singh have died on 02.02.2012 and on 12.06.2009 respectively. The said report has been sent after due enquiry.

6. Accordingly, the appeal stands abated.

7. The trial court records, if received, be sent back along with the communication of this order. Office to communicate this order to the District and Sessions Judge, concerned within two weeks from today.
