Sri Sanjay Kumar Singh, learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Natthu against the judgment and order dated 03.04.1995 passed by VI Additional Sessions Judge, Meerut in Sessions Trial No. 359 of 1992, Police Station Incholi, District Meerut.

As per office report dated 17.02.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 25.10.2021 informed that the appellant - Natthu has died on 17.5.2010. In support of which a report of concerned police station and the copy of death certificate issued by Government of Uttar Pradesh and the copy of the statements of the other witnesses have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
