The present appeal under Section 374 (2) Cr.P.C has been preferred by the appellant against the judgment and order dated 17.5.1984 passed in S.T. No. 38 of 1983.

As per the office report dated 31.1.2023, a report of C.J.M., Pilibhit dated 13.1.2022 has been received stating therein that the sole appellant Kishan Lal has died on 16.3.2021. The said report has been sent after due inquiry.

This Court has perused the said report which states that the accused-appellant Kishan Lal has died on 16.3.2021.

In view of the above, the appeal stands abated.

File consigned to records.

Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
