Heard learned counsel for parties.

Case was heard on 05.01.2023 and Court has passed following order:-

"Heard learned counsel for the petitioner and Mr. Vikram Bahadur Yadav, learned counsel for the State-respondents.

Learned counsel for the petitioner submits that controversy involved in the present petition is squarely covered with the judgement of this Court passed in Writ-A No. 10443 of 2018 (Phool Singh vs. Vs. State of U.P. & others), which was disposed of vide order dated 17.5.2018, therefore, this petition may also be disposed of on the same terms and conditions.

Learned Standing Counsel prays for and is granted one week time to verify the aforesaid facts.

List this case on 12.1.2023. "

Learned standing counsel fairly submitted that present controversy is squarely covered with the judgment referred in order dated 05.01.2023 and the only difference is that, in that matter, appointment was given to the petitioner on the post of Collection Amin and promotion was given on the post of Revenue Inspector whereas in the present case, petitioner was appointed on the post of Peon and thereafter he was promoted on the post of Collection Amin. Further, there is no difference in the legal position settled by this Court vide order dated 17.05.2018 passed in Writ-A No. 10443 of 2018.

Therefore, under such facts of the case, this petition is also disposed of in terms of order dated 17.05.2018 passed in Writ-A No. 10443 of 2018.
