1.Heard Counsel for the petitioner, Mr. Mridul Kumar, learned Standing Counsel for State-respondents and Mr. Sudhir Bharti, Counsel for respondent No.3/Land Management Committee.

2.The instant writ petition has been filed praying for a mandamus directing respondent No.2/ Sub Divisional Magistrate, Tehsil-Kasia, District-Kushinagar to decide the Case No. T202005440406821 (Land Management Committee Vs. Ram Pravesh and others) under Section 101 of U.P. Revenue Code, 2006 in the light of the judgment dated 21.12.2018 passed by this Hon'ble Court in Writ C. No.42710 of 2018 (C/M Vishambernath Janta Inter College and another Vs. State of U.P. and others) within stipulated period.

3. Counsel for the petitioner submitted that the aforementioned case is pending since 2020 for adjudication.

4. Certified copy of the order sheet have been annexed as Annexure No.5 to the writ petition in order to demonstrate that the case is not proceeding expeditiously.

5. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to respondent No.2/ Sub Divisional Magistrate, Tehsil-Kasia, District-Kushinagar to consider and decide the aforementioned case in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
