Heard learned counsel for the petitioner and Ms. Uttara Bahuguna, learned Standing Counsel.
In view of the order proposed to be passed, notices need not go to private respondent.
Present writ petition has been preferred for a direction to respondent no.2 to decide the petitioner's restoration application dated 30.11.2021 for setting aside the alleged ex-parte order/ judgment dated 13.1.2021 passed in Case No.7/2020 (Ram Sakhi v. Noor Mohammad & Ors.) under Section 116 U.P. Revenue Code within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking respondent no.2 to decide the aforesaid restoration application, if any, in accordance with law expeditiously and preferably within four weeks from the date of production of certified copy of this order but certainly after giving opportunity to all the stake holders in the matter.
