Heard learned counsel for the petitioner and learned Standing Counsel appearing on behalf of State-respondents.

It is argued by the counsel for the petitioner that wholly illegally the proceedings were initiated by the gaon sabha against the petitioner under Section 67 of the U.P. Revenue Code, 2006. It is further argued that Division Bench judgment dated 31.03.2022 is already in his favour, hence the proceedings initiated by the gaon sabha is perse illegal.

On the other hand it is argued by the learned Standing Counsel that in case it is so the petitioner is free to make his objections in the pending proceedings before the Tehsildar concerned.

In view of the same, the present petition is disposed of finally with a direction to the petitioner, if so advised, to file such application before the concerned Tehsildar. In case, such an application is filed by the petitioner before the Tehsildar concerned, the same shall be considered and decided in accordance with law, expeditiously.
