Ms. Arti Agarwal, learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Genda Lal against the judgment and order dated 03.09.1992 passed by Special Judge, E.C. Act, Etah in Special Case No. 2 of 1991, Police Station Kotwali Dehat, District Etah.

As per office report dated 07.12.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 14.09.2022 informed that the appellant - Genda Lal has died on 10.11.2017. In support of which a report of concerned police station and the copy of death certificate issued by village pradhan and the copy of the statements of the other witnesses have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
