Short title and commencement.- (1) These rules may be called the 'Punjab Prisoners' Training Courses in Dairying, Mixed-farming and Piggery [outside the Jails] Rules, 1979.

(2) They shall come into force at once.

Definitions.- In these rules, unless the context otherwise requires -

(a) 'Act' means the Prisons Act, 1894 (Central Act IX of 1894) :

(b) 'eligible prisoner' means a 'convicted criminal prisoner' who is eligible for being sent out of a Jail for training under rule 3 and includes a prisoner who is selected for being sent out of a Jail for such training by the Inspector General of Prisons, Punjab under rule 4;

(d) 'training' means training in Dairying, Mixed-farming or Piggery.

Eligibility for sending out convicted criminal prisoners for training.- No convicted criminal prisoner shall be selected for being sent out of a Jail for training unless -

(i) he is a casual prisoner;

(ii) he is not less than twenty one years and not more than fifty years of age, and has good physical and mental health without any history of a disease which may be aggravated during the training;

(iii) he is fit for manual and mental labour;

(iv) his previous conduct in jail has been good :

(v) he has not more than one previous conviction;

(v) he is a prisoner sentenced to rigorous imprisonment for a period of not less than one year or is a prisoner sentenced to simple imprisonment but elects to do labour and in either case the conviction is for an offence other than that mentioned in Chapters V-A, VI and VII of the Indian Penal Code, 1860 and sections 328, 364, 376, 382, 386 to 389, 395 to 402, 413, 459 and 460 of the said Code and he also fulfils the following conditions -

(a) in case he is a prisoner sentenced for a period, less than life imprisonment, he has undergone one-twelfth of the substantive sentence inside the Jail;

(b) in case he is sentenced to life imprisonment he has undergone at least three years of his actual sentence inside the Jail;

Note. - For the purpose of this clause, while selecting prisoners for being sent out for training preference should be given to those prisoners who have successfully availed parole/furlough at least once during the period of three years spent inside jail.

(vii) he was convicted by a Court in the State of Punjab;

(viii) no criminal case is pending against him;

(ix) he had not at any time escaped from the jail;

(x) he is willing to undergo training and has good family background;

(xi) he has an aptitude for training and is likely to resettle on Dairying, Mixed-farming or Piggery after release.

(xii) he is a Matriculate with Science, relaxable in a suitable case for a matriculate (without Science), if the prisoner is an exceptionally good worker; and

(xiii) the unexpired portion of his sentence is more than six months on the date he is sent for training.

Power of Inspector General to select a prisoner for training in Dairying, Mixed-farming, Piggery etc.- Notwithstanding anything contained in rule 3, the Inspector General of Prisons may, for reasons to be recorded in writing, select any convicted criminal prisoner, who is not eligible under rule 3, for training.
Ineligibility.- No prisoner, who is transferred from the Open Air Jail, Nabha, on administrative grounds, shall be eligible for being sent out for training.
Selection of eligible Prisoners.- (a) The initial selection of eligible prisoners shall be made by the Local Selection Committee consisting of the Superintendent Jail, as Chairman and the Deputy Superintendent Grade I, Deputy Superintendent Grade II (Maintenance), Deputy Superintendent Grade II (Factory), Assistant Superintendent Incharge Factory, Medical Officer and the Welfare Officer as other members of that Committee.

(b) The list of prisoners, selected by the Local Selection Committee, shall be submitted, with the Descriptive Rolls, to the Inspector General of Prisons, Punjab, by the Superintendent Jail for approval.

Guarding of trainees and their transportation.- (a) For a batch of twenty trainees, one Head-warder and two warders, of repute, shall be provided as an escort in plain clothes. The members of the escort will remain sitting in the class-room alongwith the trainees.

(b) The Training classes ordinarily shall be for four hours, from 9 A.M. to 1 P.M. and the trainees shall start from the Jail at 8 A.M. and return by 2 P.M. from the Training Institution.

(c) A five-days' week for the training shall be observed, from Mondays to Fridays, All holidays observed by the authorities of the Training Institution shall also be close days for the trainees.

(d) The transportation of the batch of trainees, from Jail to the Training Institution shall be done by the Superintendent Jail concerned at the expense of the Jail.

Special lodging arrangements for trainees inside jail and their being exempted from any other Prison Labour.- (a) All the trainees shall be lodged in a separate barrack or ward and given all facilities for pursuing their studies;

(b) Subject to their pursuing the training diligently, they shall be exempted from any other labour which they are otherwise required to perform under para 678 of the Punjab Jail Manual.

Supervision over the trainees outside the Jail by the Superintendent Jail and other executive officers.- The Superintendent of the Jail shall go over occasionally to see how the trainees are working and behaving at the Training Institution. He shall also depute some other officers, subordinate to him, for similar surprise checks.
Dress of the trainees at the Training Institution.- (1) All the trainees shall go to the Training Institution in private clothes, to be arranged by them.

(2) If any trainee is not in a position to have his own private clothes, due to his family circumstances, he shall be provided private clothes out of the 'Punjab Jails Canteen Funds' after proper scrutiny.

Training Certificate.- Each trainee shall be eligible for the issue of the certificate for having acquired proficiency in the training.
Application of Prisoners Act and Rules etc.- Except as provided in these rules all the provisions of the Prisoners Act, 1900 and rules made thereunder and the provisions of the Punjab Jail Manual shall apply to the trainees.
