The Orissa Settlement and Consolidation Service (Departmental Examination) Regulations, 1985

Notification No. 613-V. Con-9/85-CS, dated 22nd June, 1985. - In pursuance of Rule 16 of the Orissa Settlement and Consolidation Service (Recruitment and Conditions of Service) Rules, 1980 the Board of Revenue hereby makes the following regulations, namely :

  1. Short title and commencement.- (1) These Regulation may be called the Orissa Settlement and Consolidation Service (Departmental Examination) Regulations, 1985.

(2) They shall come into force on the date of their publication in the Orissa Gazette.

  1. In these Regulations, unless the context otherwise requires -

(a) "Board" means the Board of Examiners, Orissa constituted under Regulation 3;

(b) "Board of Revenue" means the Board of Revenue, Orissa;

(c) "Examination" means the Departmental Examination;

(d) "President" means the President of the Board of Examiners;

(e) "Secretary" means the Secretary to the Board; and

(f) All other words and expressions used but not defined in these regulations shall have the meaning respectively assigned to them in the Orissa Settlement and Consolidation Service (Recruitment and Conditions of Service) Rules, 1980.

  1. Constitution of Board of Examiners.- (1) There shall be constituted a Board of Examiners consisting of the Member, Board of Revenue and such other members as may be nominated by the Board of Revenue from time to time.

(2) The Member, Board of Revenue shall act as the President and shall preside over all meetings of the Board of Examiners.

(3) The Secretary, Board of Revenue shall act as the ex officio Secretary to the Board.

  1. Place and date of examinational.- The examination shall be conducted by the Board and it shall be held at such place or places as the Board may decide.

(2) The examination shall be held twice every year at intervals of at least four months.

(3) The date or dates of the examination shall be fixed by the President of the Board.

(4) The Board shall notify in the Gazette the exact date, place, and programme of the examination at least six weeks before the date so fixed for the examination and the last date by which applications for admission into the examination may be received by the Board.

  1. Application for admission into the examinational.- As soon as notification under Sub-regulation (4) of Regulation 4 is made, a probationer who is required to pass the examination may submit an application in the form specified in the Appendix I direct to the Secretary so as to reach him not later than the date specified in the notification.

(2) Any application received after the said date shall not be considered:

Provided that the Secretary may, for good and sufficient reasons to be recorded in writing, admit into the examination a probationer on his application who failed to submit the same, within the aforesaid date.

(3) The Secretary shall prepare a list of probationers who have been admitted into the examination and no one whose name does not appear in the list shall be allowed to it for the examination.

  1. Subjects of the examination.- (1) The examination shall be on the following subjects, namely :

(a) Oriya,

(b) Laws, and

(c) Accounts.

[(2) A probationer who has passed in Oriya subject in the High School Certificate Examination conducted by the Board of Secondary Education, Orissa or in an examination equivalent or superior thereto may, on application made to the Secretary, Board of Revenue in that behalf, be exempted by the Secretary, Board of Revenue from passing the examination in Oriya and the orders of the Secretary, Board of Revenue passed under this sub-regulation shall be final.]

  1. Syllabus for the examination in Oriya.- The standard, syllabus and the mode of written and viva voceexaminations in Oriya shall be the same as prescribed in the Orissa Administrative Service, Class II (Departmental Examination) Regulations, 1981, as amended from time to time.
  2. Syllabus for the examination in laws.- (1) The examination in laws shall consist of the following papers, namely :

(i) Civil Laws and Revenue Laws, and

(ii) General Laws.

(2) The syllabus and the mode of written and viva voce examination shall be the same as prescribed for Civil Laws and Revenue Laws and General Laws in the Orissa Administrative Service, Class II (Departmental Examination) Regulation, 1981, as amended from time to time.

  1. Syllabus for the examination in Accounts.- The syllabus and the mode of examination in Accounts shall be the same as prescribed in the Orissa Administrative Service Class II (Departmental Examination) Regulations, 1981, as amended from time to time.
  2. Miscellaneous provisions for conducting the examination.- The provisions in the Orissa Administrative Service, Class II (Departmental Examination) Regulations, 1981, so amended from time to time, relating to appointment of paper setters and examiners, arrangements for examination, penalties, viva vocetest and submission of answer books and mark-sheets by the examiners and their tabulation shall, mutatis mutandis, be applicable to the conduct of Departmental Examination for the probationers of the Orissa Settlement and Consolidation Service.
  3. Standard for pass.- A probationer shall be deemed to have passed the examination-

(a) in Oriya, if he secures at least sixty per cent of the marks in all papers on the subject taken together;

(b) in the written examination or viva voce test of the Civil Laws and Revenue Laws and the General Laws, if he secures at least sixty per cent of the marks in the examination; and

(c) in Accounts, if he secures at least sixty per cent of marks in the examination.

  1. Approval and publication of the results.- (1) The Secretary shall place the tabulated marks before the Board for its consideration.

(2) With the approval of the Board, the Secretary shall publish the results ordinarily within two months from the last date of the examination in the Gazette.

  1. Date of passing Departmental Examinational.- A probationer who has passed the examination shall be deemed to have passed it on the date on which the results are published, -or if he passed the examination by instalments, on the date of publication of the results of the examination in which he finally passed.

(2) The names of probationers who have passed the examination shall be published by the Secretary in the Official Gazette.

  1. Meeting of the Board of Examiners.- (1) The Secretary, with the approval of the President, shall convene the meetings of the Board from time to time for transacting any business under these regulations.

(2) Transactions of routine nature may be carried on by circulation among the members of the Board at the direction of the President.

  1. Preservation of answer papers etc.- All answer papers, mark-sheets and tabulation registers shall be preserved for a period of three calendar years immediately following the year of the examination.
  2. Repeal and savings.- The Orissa Settlement and Consolidation Service (Departmental Examination) Regulations, 1977 in force immediately before the commencement of these regulations are hereby repealed :

Provided that any order made or action taken under the regulations so repealed shall be deemed to have been made or taken under the corresponding provision of these regulations.

  1. Subject to the overall supervision of the State Government, the Board of Revenue may issue such instructions not inconsistent with the provisions of these regulations as it considers necessary to regulate matters not specifically covered by the provisions of these regulations.
