UAE: Mother wins custody of child as ex-husband's claim of her not taking care of child after new marriage gets rejected by Supreme Court

A mother has won the custody of her child after her ex-husband claimed she wasn't taking care of the boy after she got married to a "foreign man".

The Federal Supreme Court in Abu Dhabi rejected the appeal filed by the Emirati father.

Court documents stated that after the Emirati couple got separated a few years ago because of irreconcilable family disputes, the custody of the boy, who is below ten, was granted to his mother. The court had also ordered the Emirati man to pay the child's monthly expenses and Dh2,000 alimony to his ex-wife.

After some time, the woman got married again and the couple started living together with the boy. The father then filed a lawsuit demanding custody of his child. He also demanded that his ex-wife pay back the Dh50,000 he had spent on her in paying alimony and house rent.

The man said in his lawsuit that his ex-wife was no longer taking good care of his son and she always traveled abroad with her husband and left his child alone with a housemaid. The man also claimed that he wasn't comfortable with his child growing up in the home of a foreign man.

Both the Court First Instance and the Appeals Court had dismissed his case and ruled that custody of the child remain with the mother.
