The Allahabad High Court has expressed its displeasure on the growing habit of disobeying the Court order among state government officials. The court described it as regrettable for the state and directed all subordinate officers to follow the Court order at the first instance.
This order has been given by Justice VK Birla while dealing with the contempt petition filed by Deepti Mishra before the court for punishing the opposite party (Principal Secretary, Higher Education) for disobedience of the judgment and order passed by the court.
The court said that,
“This Court is noticing everyday that apparently the officers concerned, who were directed to act as per the order of the Court, are not complying with the orders at the first instance and the aggrieved party is forced to file contempt application and even after granting further time to comply with the order of the writ Court passed in contempt application, the orders not being complied with. Apparently the Officers are becoming habitual and not complying with the orders of this Court at the first instance.”
With this, the court has issued a notice to Principal Secretary Higher Education Monica Garg and asked the principal secretary to appear and clarify why charges should not be framed against her for punishing him in contempt.
