The High Court of Punjab and Haryana has made it clear that any person can't be held to be in illegal or unlawful detention if they have been kept in quarantine by the authorities due to the Covid-19 pandemic, reports Ajay Sura.
Justice Lalit Batra also clarified that the habeas corpus plea for the release of such persons isn't maintainable while dismissing a plea filed by 2 residents of Assam and Bihar who were kept in quarantine/isolation by Haryana health authorities.
Justice Lalit Batra observed that “Basic steps initiated by the Govt of India and the states to curb the impact of Covid-19 are meant for service to the humanity and such petitioners, have been rightly kept in a quarantine centre".
The petitioners had attended the Tablighi Jamaat event in Delhi and were kept in quarantine. Aggrieved by the confinement, the duo approached the High Court seeking “release from illegal detention by the Haryana Govt”.
