Modi Govt to CJI Khehar: Ensure expeditious disposal of Commercial Disputes at all levels

It is necessary to improve India's global standing in ease of doing business.

The Modi govt. has written to CJI J S Khehar seeking expeditious adjudication of the Commercial Disputes, necessary to improve our country's global standing in ease of doing business.

In a letter to Chief Justice of India, law minister Ravi Shankar Prasad said the Supreme Court could provide necessary guidance to lower courts & prohibit unnecessary adjournments besides directing them to serve the summons electronically.The letter said that the Supreme Court can provide necessary leadership for proper implementation of existing provisions of the Code of Civil Procedure(CPC) relating to grant of adjournment, adherence to timelines & electronic filing, electronic service of summons in 71 city courts which include 11 in Delhi & 60 in Mumbai immediately.

Ravi Shankar Prasad said doing this would help timely & effective enforcement of the contracts & ensure improvement in India's ranking in the ease of doing business index.

Referring to World Bank's annual 'Doing Business' report, Minister Ravi ShankarPrasad said India's ranking had improved from 178 in year 2016 to 172 in year 2017 relating to 'enforcing contract' indicator.

This indicator measures the cost & time for resolving a standardized commercial dispute through a local court where the case comes up for the 1st time.
