HC questions authority of the Finance & Accounts Officer, Basic Education, Gorakhpur for withholding the payment of salary [Read Order]

The Allahabad High Court has asked Finance and Accounts Officer, Basic Education, Gorakhpur to submit his response that despite the order of the District Basic Education Officer, with what authority they have withheld payment of the outstanding salary of the petitioner. This order has been given by Justice Ajit Kumar, while hearing the petition filed by retired Assistant Teacher Senior Basic School, Jharwa Satya Narayan Giri and others.

The Court has said that, “Let the Finance and Accounts Officer, Basic Education, Gorakhpur file an affidavit as to under what capacity he has withheld the payment of salary of the petitioner in spite of the order passed by the District Basic Education Officer by the next date fixed.”

The lawyer said that the petitioner retired on 31 March 2016 due to changes in the education session. Earlier he was not allowed to work, assuming he retired from July 1, 2015. The court order re-assumed service continuity and paid salaries. But the salary for the period of re- joining from July 2015 was not given. The BSA has directed payment of arrears of salary.

Despite this, this petition was filed because payment was not made. The court has listed the matter on 17 November and directed to Finance and Accounts Officer, Basic Education, Gorakhpur the accountant to file the affidavit by 17 November.
