Gujarat High Court stays government circular to outsource MGNREGS jobs

The Gujarat High Court has stayed implementation of a government resolution that facilitated outsourcing of employment of those persons who have been appointed to implement the Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGS). Justice A P Thaker issued notices to the state government and its departments, making them returnable on June 11.

 

As many as 39 persons, who have been appointed for various positions under MGNREGA, had approached the Gujarat high court, seeking to quash a government resolution (GR) dated May 20, 2019, where the state government made provisions for outsourcing appointments of those working to implement various schemes of the act.

The 39 petitioners contended that they have been appointed after clearing the examination conducted by the Gujarat government in 2014 and their contracts have been renewed every 11 months by the government. However, the May 20 government circular says that their contracts will be terminated and the said vacancies will be filled through outsourcing agencies.

The petitioners sought protection of their contractual service from outsourcing and continuation of their contractual service until the scheme is in implementation.
