A company named WaterWipes Unlimited which is famous for producing biodegradable baby wipes has recently taken legal action against Sethos Holdings Ltd. and Waterful Ltd. Waterwipes approached the commercial court alleging that they are infringing its trademark. WaterWipes Unlimited Company made the submission during Commercial Court proceedings that the “Waterful” brand of Sethos Holdings Ltd. and Waterful Ltd. is infringing its intellectual property rights. However, the plaintiff further claimed that the infringements were in breach of a number of EU trademark regulations.
The headquarters of WaterWipes is situated at Donore Road, Drogheda, Co Louth, and Ireland. The Irish Company is seeking an injunction with an aim of restraining the Waterful companies or their agents from further infringing trademarks of which WaterWipes is a proprietor. Waterful companies are having their offices in Camden Street, Dublin. However, it further seeks an injunction where the company wants to restrain the defendants from acts like advertising, stocking, offering, marketing, or selling wipes under or by means of the names and/or signs “Waterful” and/or “WaterfulWipes” and/or “Waterful Wipes” including other confusingly similar names. The Irish Company did not just stop here but also seeks damages based on an account of the profits made by defendants as a result of the alleged infringement.
WaterWipes Unlimited submitted, “The defendants have advertised ‘Waterful Wipes’ on Facebook and subsequently change it to ‘Waterful Plastic Free’. They further chose to promote their products on Instagram and also make themselves to be identified as ‘Waterful Wipes’ in a Google search.” Mr. Justice David Barniville was hearing this matter and admitted the case to the fast-track Commercial Court list on the application of Waterwipes. However, Paul Couglan BL is representing the Irish Company before the court. Meanwhile, the judge gave directions to both parties for preparing their case for the purpose of the hearing. He also urged the parties to discuss the matter within them and consider mediation as a first means of resolving it.
The story behind the establishment of this Irish Company is very interesting. It was founded by Edward McCloskey when his newborn daughter suffered from severe nappy rash. He conducted extensive research upon the wipes industry where he couldn’t find a single baby wipe that didn’t contain any sort of chemicals or other ingredients that would have been too harsh for toddlers’ sensitive skin. So he decided to create his own wipes. He put his heart and soul into this process. After a lot of hard work, testing, and scientific research, he came up with his Irish Company “WaterWipes”. This company started making wipes that are pure, gentle, and safe for the most delicate skin of a baby. Many parents all over the world are now using their wipes for their newborn children.
