The Saket Additional Sessions Court has granted bail to businessman Samir Modi in an alleged rape case, observing that "the severity of allegations cannot be the only consideration for granting or denying bail" and that courts must examine the "totality of circumstances" before reaching a decision.
The case arose following Modi’s arrest on September 18, 2025, pursuant to an FIR registered by the Delhi Police on September 10. According to the prosecution, Modi allegedly coerced the complainant into a sexual relationship over nearly five years, from 2019 to August 2024.
Modi’s counsel, Advocate Simran Singh, contended that the arrest occurred without a preliminary investigation and highlighted the alleged blackmail threats, supported by purported WhatsApp messages demanding substantial sums and property from Modi under threat of legal action.
Additional Sessions Judge Vipin Kharb noted, "The case of prosecutors that consent of the complainant for a sexual relationship was obtained as the accused was in a position of control or was having dominance over the complainant or on a false promise of marriage, would be established once the prosecutors step into the witness box and lead evidence. However, no custodial interrogation is required for the said purpose." The Court clarified that such allegations must be tested during trial, rather than relying solely on custodial interrogation.
The Court imposed conditions on the bail, including that Modi shall not leave India without prior court permission, shall attend all trial hearings, shall refrain from tampering with evidence, shall not communicate with the complainant or prosecution witnesses, and shall abstain from any criminal activity during the proceedings. Modi furnished a bail bond of Rs. 5 lakh.
Advocate Singh, on behalf of Modi, emphasized that the matter is now sub-judice and expressed confidence in the judicial process, requesting respect for the privacy of Modi, his wife, and their two young daughters. Singh noted the distress caused to the family due to the public nature of the proceedings.
