In a compassionate decision, the Bombay High Court has granted interim bail for four weeks to Jitendrakumar Yadav, a murder convict from Tundla in Firozabad district of Uttar Pradesh. Yadav's 14-year-old daughter tragically died by suicide, prompting him to seek temporary release to perform her last rites and support his grieving wife and 2-year-old child.

The bench of Justices Revati Mohite Dere and Gauri Godse considered the urgent plea and granted the interim bail, suspending Yadav's sentence for the duration of his release.

Yadav's plea was initially filed during the Covid period, requesting temporary bail. To support the application, his lawyer, Manas Gawankar, presented a draft amendment along with a letter from the sarpanch of Yadav's village, verifying the authenticity of the situation. The court acknowledged Yadav's prior release on parole without any misuse of liberty and his punctuality in reporting, contributing to the decision.

The murder conviction against Yadav stems from a case in Silvassa, Dadra and Nagar Haveli, where he and four others were found guilty of murdering a man. According to the prosecution, the main accused had an illicit relationship with the victim's wife. The key accused hired assassins from Firozabad, who traveled to Silvassa and fatally shot the victim outside an ATM in November 2011. The case relied on call data records and circumstantial evidence, revealing Yadav's involvement and receiving a payment of Rs 40,000 for carrying out the plan.

Acknowledging the unique circumstances and the genuine need for Yadav to fulfill his religious obligations and provide support to his family, the Bombay High Court granted him temporary bail on compassionate grounds. During the four-week period, Yadav is required to visit the concerned police station every alternate day before returning to prison.

Yadav's legal team expressed gratitude to the court for considering their application and allowing him to carry out his religious duties during this challenging time. While the exact reason behind Yadav's daughter's suicide remains unknown, his wife, who contacted his lawyers, was understandably distraught and unable to disclose further details. The court's decision reflects a compassionate approach to ensure Yadav can fulfill his responsibilities while keeping in mind the seriousness of his conviction.
