On Tuesday, a family court in Punegranted divorce by mutual consent to a techie couple barely 8 days after they moved the plea.

Advocate Vikrant Shinde, who represented the woman in the case said that “The court relied on a 2017 Supreme Court judgment, which held that the mandatory six-month cooling-off period, the norm for divorce by mutual consent, can be waived".

He told reporters that “The couple, in the instant case, have been living separately for over a year-and-a-half before they decided to apply for divorce by mutual consent".

Advocate Shinde said, “As of yet, there is no known case prior to this in which a divorce by mutual consent was granted in such a short span. A few months ago, we had a case where divorce was granted in 13 days. The SC directives provide that the first date of hearing of a divorce plea by mutual consent cannot be granted inside eight days. As such, this appears to be the least term in which a divorce order has come through.”

Shinde added that “The couple were working with a leading IT firm in Pune when they got married in 2015. Later, they shifted to Bengaluru. They have no children. The couple had differences over many issues & would often quarrel before parting ways on June 30, 2018".

“The woman has since returned to Pune & taken up a job with an IT firm. The man continued with his job in Bengaluru. On Jan 6, they moved the divorce plea & it came up for hearing on Tuesday before family court judge SR Kafre. In between, they also went through a counselling process,” said Shinde.
